Jim Williams, the owner and operator of the Hurricane City website, recently recovered the domain names: hurricanecity.net, hurricanecity.org, and hurricanecity.info. The UDRP panel found that Mr. Williams had established common law trademark rights in the HURRICANE CITY mark despite the lack of a formal trademark registration. The panel further found that the domain names at issue were confusingly similar to Mr. Williams’s HURRICANE CITY mark and that the domains had been used in bad faith–where they were used to mimic Mr. Williams’s HurricaneCity.com website. Thus, the panel transferred the domain names to Mr. Williams.
